1. Acceptance of Terms

By downloading, installing, or using AI Pranks, you agree to be bound by these Terms of Service and our Privacy Policy. You must be 13 years or older to use this service. If you do not agree to these terms, please do not use our app.

2. Service Description

AI Pranks uses artificial intelligence to generate humorous prank images. The service is for entertainment purposes only. We use third-party AI services to generate images and do not guarantee specific results, quality, or availability.

3. AI-Generated Content Disclaimer

All generated images are created by third-party AI systems. AI output is unpredictable and may contain errors, artifacts, or unexpected results.

We are not responsible for:

  • The accuracy, quality, or appropriateness of generated images
  • How you choose to use or share generated content
  • Any consequences arising from the use of generated images
  • Emotional distress, reputational harm, or relationship damage resulting from pranks
  • Third-party reactions to pranks you share

You are solely responsible for:

  • Reviewing all generated content before sharing
  • Ensuring pranks are appropriate for intended recipients
  • All consequences of sharing generated content

4. User Responsibilities

You agree to:

  • Only upload photos you have the right to use
  • Obtain appropriate consent from people appearing in photos
  • Review all generated content before sharing
  • Ensure pranks are harmless and recipients will find them amusing
  • Reveal pranks to recipients in a timely manner
  • Not upload photos of minors without parental consent
  • Not upload illegal, offensive, or inappropriate content

5. Prohibited Uses

You may not use AI Pranks to:

  • Create deepfakes or misleading content for malicious purposes
  • Harass, bully, intimidate, or defame any person
  • Commit fraud or deception beyond harmless pranks
  • Violate anyone's privacy or publicity rights
  • Upload inappropriate, offensive, sexually explicit, or illegal content
  • Attempt to generate harmful, illegal, or inappropriate content
  • Circumvent safety measures or content filters
  • Reverse engineer, hack, or exploit the app
  • Use the service for commercial purposes without written permission

6. Credits and Purchases

Purchase Terms:

  • Credits are purchased through Apple App Store
  • All purchases are subject to the respective store's terms and refund policies
  • Prices are displayed at time of purchase and may change
  • Credits are non-transferable between accounts or users

Non-Refundable Policy:

  • Credits are non-refundable once purchased
  • Unused credits have no cash value
  • Credits cannot be exchanged for money or transferred

Credit Expiration:

  • Credits expire 12 months after purchase
  • Upon expiration, unused credits are forfeited without compensation

Service Termination:

  • If we discontinue the service, unused credits will not be refunded
  • If your account is terminated for Terms of Service violations, all credits are forfeited
  • We may discontinue or modify the service at any time without obligation to refund unused credits
  • We recommend using credits promptly after purchase

7. Content Monitoring and Safety

Consent to Monitoring:

By using AI Pranks, you expressly consent to our monitoring, review, and storage of all content, including:

  • Photos you upload (input content)
  • Images generated by the AI (output content)
  • Associated metadata and usage patterns

Purpose of Monitoring:

We monitor content to:

  • Prevent abuse, fraud, and malicious use of the service
  • Ensure compliance with these Terms of Service
  • Protect users, third parties, and the public
  • Improve AI safety and content quality
  • Comply with legal obligations and law enforcement requests

Content Retention:

  • All uploaded and generated content is retained for up to 12 months
  • Content under safety review may be retained longer
  • Content may be used to improve our content moderation systems

No Expectation of Privacy:

You acknowledge that you have no expectation of privacy regarding content you upload or content generated through the service. All content is subject to review at any time without notice.

8. Intellectual Property

  • You retain ownership of photos you upload
  • You own the generated prank images, subject to our license below
  • You grant us a worldwide, royalty-free license to use uploaded and generated content for operating the service, safety monitoring, and service improvement
  • The AI Pranks app, brand, technology, and all related intellectual property remain our exclusive property

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Accuracy or reliability of AI-generated content
  • Uninterrupted or error-free operation
  • Availability of the service or any features
  • Results meeting your expectations

Third-party AI services may change, degrade, or become unavailable without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Our total liability is limited to the amount you paid for credits in the 12 months preceding the claim
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages

We are not liable for:

  • Content generated by AI
  • Actions or reactions of prank recipients or third parties
  • Third-party service failures or changes
  • Service interruptions, modifications, or termination
  • Emotional distress, relationship damage, or reputational harm
  • Lost data, profits, or opportunities
  • Any consequences of sharing generated content

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Pranks, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the service
  • Content you upload or generate
  • Your violation of these Terms
  • Claims from prank recipients or third parties
  • Your violation of any laws or third-party rights

12. Termination

  • We may suspend or terminate your access at any time, with or without cause or notice
  • Grounds for termination include but are not limited to violation of these Terms
  • Upon termination, all credits are forfeited without refund
  • Sections 3, 6, 7, 9, 10, 11, and 13 survive termination

13. Governing Law and Disputes

  • These Terms are governed by the laws of Norway
  • Any disputes shall be resolved in the courts of Norway
  • For EU consumers: You retain any mandatory consumer protection rights under your local law
  • For users outside Norway: You consent to jurisdiction in Norway

14. Changes to Terms

  • We may update these Terms at any time
  • Material changes will be communicated through the app
  • Continued use after changes constitutes acceptance
  • If you disagree with changes, you must stop using the service
